I doubt it. These ringtones probably were pirated and are therefore illegal.

Some legal way to share ringtones? 10-30 seconds of some song is illegal?
Somebody know more about legal things related to ringtones?

These LOOK and FEEL pirated. I would say illegal since the artist isn't getting paid. Remember NOTHING in this world is FREE.

For fair use, the amount of time of a song has little to do with it. The substaintiality of it is what matters. For example, you use the hook of the song. This may only be 3-5 seconds but is immediately recognizable (hence it is called the hook). That would be a substantial use of the song. Futhermore, this only applies to fair use. Fair use only applies when the intent is non-commercial (among other things). While the ringtones are free, the intent is to get people to click on the ads. No fair use here.

As others have said, you are not likely to find free non-infringing ringtones because the people that made the ringtone have to pay a fee to the copyright holder in order to make the ringtone. If they paid to make it, they won't give it away for free.
