In this case "famous" is a legal term to describe the status of a trademark. Having a "famous mark" allows the trademark owner to get an injunction against the person/business infringing the trademark more easily than if it is not. http://thomas.loc.gov/cgi-bin/query/R?r109:FLD001:H56964 Whether the Rich Jerk's trademark qualifies as "famous" or not is an issue that would have to be determined in court.
Simple and plain Rich Jerk sucks and his book isn't worth a thing if you ask me. He just being a bully.
I don't get worried about anything until someone knocks on my door.. just report his email as spam, delete the email, and go on with your life. It's your constitutional given right to have your own opinion about a service and be able to talk about it.
But the issue is about a trademark dispute. While I wish the owner of www.richjerkscams.com no ill, and hope he sorts it out with a result in his favour what you're saying has nothing to do with the problem at hand. It would be like saying microsoftscams.com is covered by a constitutional right to have an opinion.
Ok, this guy kindda bugs me, but his affiliate sites are a bit intriguing. I already got his ebook and I think it is good. I just want to know whether his pre-made affiliate site is really worth it... from first impression, apparently NOT! Why not just go with cheap hosting and do our own extended clickbank reviews, implement our adsense and stuff? Does anyone of you guys own one of his pre-made affiliate sites? If so I'd want to enquire about some points (already contacted him but 3 days no reply): -Does his affiliate site come with updated reviews that change from time to time, depending on new clickbank products or not? -How many products does he (or his staff) review by default? and can we add our own clickbanks and request reviews? -How long is the review? -Does RJ keep the leads he captures from the affiliate sites to himself or do we get to receive them too? -Kept saying before that he'll be adding new features to the affiliate sites... are these features ready?
Hey guys, www.richjerkscams.com is completely harmless if you ask me, I guess it's about Rich Jerk's Cameras? (Cams) I see is that some people imply you claim it's a scam in your domain name. I think you can be create and make clear you don't use the word scam in your domain domain. For example, make a logo with a camera, camera can be an allusion for a review. Or just make a joke and "review" cameras Rich Jerk uses in "his" You Tube videos and make it visible enough.... just giving some ideas...
Hi, Reminds me of my buddy Mike Row. When he published his first software for PC he was quick to register his Companies website as MikeRoweSoft.com You can imaging what happened next. It still remains parked at the microsoft dns search error website, and is registered to Microsoft. You are in the same boat. You have a for profit website using the name of a registered trademark. You will lose easily. Mike
in my opinion people take the web to serious, domain names especially. As mentioned above, that mikerosoft domain i think microsoft was harsh claiming that as there own. Money is the ruination of man, especially alot of money! I'm happy making a few bucks here and there but nothing more
If I remember correctly Microsoft regreted everything (under public preasure). In the end they paid his scholarship in exchange for a domain and such. Mike Row is his name so it's not so clear who would won the case in court. Probably Mike. This is a different issue, the word scam in the domain name impies something about their products etc. that's the problem.
Hello; Ryan I don't really know much about all the legal matters online but, wouldn't TradeMarks be about the same as CopyRight I wouldn't take this lightly if it was me Seek Legal Advice
Then I guess a trademark, lets say a logo, would then go under copyright law. But a registered trademark... well it would need to be registered. To get all those advantages and the exclusive right to use it.
Even if it goes to court you may just be asked to take down the site. It's not like you're making millions using their TM. But is it worth the risk? Please keep us posted.
If I am "Rich Jerk", I definitely won't be stupid enough to take a site called "Rich Jerk Scams" to court. Then everyone will know about this site.
ive honestly not read through all of this however does it not seem funny that th person wrote the email themselves instead of gettig teir lawyer to do it?
