If you have a script that has resell rights for 29.99 In its files says it cannot be sold for less but can be sold for more. Would I be able to sell it for 29.99 with a 25.00 instant rebate? To qualify for the rebate would require the buyer to answer say a 1 question survey or even do something like a social bookmark or a post in a forum? Would this idea work for selling this product?

If the concept of price fixing and restraint of free trade will stand the test of the courst in the US; the sofware industry is the only place it will.

I personally do not believe that setting a "can not be sold for less than" price is legal. Setting a "can not be advertised at less than" seems to be legal.

Just my opinion and I am not willing at this time to spend $ defending the position.

Why would you want to lower the selling price anyway? No way you will do 5 times the volume to make up the difference.

Just to sell it someone for the full price and have them sell it on proxy for whatever price you want.

Privity of contract would mean that you can then charge whatever price you want, since they would not be bound by any of the terms you were originally bound with.

I would have to actually read the terms properly but what I said would work in 99% of instances.
