You said the TM holder will pay you your registration fee. That is a false statement. Some may do it, but they are under no obligation to do it. There are plenty of TM holders than won't pay you a cent. You said you will not be sued. That is a false statement. Most may ask for the domain back before filing a lawsuit, but again, they are under no legal obligation to do it and can sue you without any notice. The only good advice you gave is to stay away from trademark domains.
You will find domains like that available for a reason. Because it is such common knowledge not to touch them because of infringement that they don't even bother to register them and most people know enough about the web to not even think about it. They know they are out there, and they probably leave them just so their legal staff will have something to do every now and then. Why would you want someone else's name anyway? Because you think you can get traffic by aligning yourself with a well known brand? If that's some big, great idea to you, then you need to leave the web business.
