I bought a site with the domain registered on registerfly as a reseller of enom. It was transferred across to my account on registerfly but I didn't update the WHOIS details. I'm assuming that now the email from enom went to the old owner and he's now stolen the domain back off me, since it's setup with his nameservers now rather than the ones I entered. What can I do? The domain/site set me back $800 (I later realised the real worth was probably $100) so I'm kinda annoyed. I guess it's partly my fault for not updating WHOIS details. I've fired off emails to registerfly, enom and the old owner but no response so far.
Since the registrars in question have no discernible proof that theft occurred, your only possibly feasible option is to seek legal advice. Registrars don't have a 100% foolproof way of knowing who's lying and who's truthful, and there's no requirement for them to mediate such disputes. Good luck trying to resolve your issue.
I believe your only recourse would be a civil lawsuit against the individual that did this to you. You can talk to any attorney about mailing a letter demanding the return of the domain but it will probably cost you more than the domain is worth. You could also check about filing a suit in small claims court if you have evidence you bought the domain from this individual and it has now stolen it from you. You could also try to get this individual prosecuted for theft if you have adequate proof of what you have said here. But frankly I think your best bet is just forgetting about it and register another domain. gene
How did you pay? If it was Paypal MAYBE you can dispute the payment (ie never received the domain). Hopefully the whois is showing the exact same information as the paypal payment receipt that you received. Good luck.
