regarding youtube

    Hey guys,I'm not sure if this is the right place to post this but I wanted to know if there are any legal issues if I put a youtube video on my website.is there any infringement issue for that?

    if you embed it from youtube on your site then of course not. its perfectly legal. Now if you download it and then upload it 2 your server than you might be in trouble

    it is not perfectly legal. In fact, it hasn't specifically been decided in the courts yet. There are two schools of thought on this by some very good legal minds. Which school of thought will win will mostly depend on what Federal Court Circuit this ends up in.

    While YouTube is protected, you may not be. How is this so? Well, for starters somebody (probably not a YouTube employee) uploaded the file to YouTube. When you embed a video on your site, you choose to take that action. This is different than user generated content. If you embed something that is obviously infringing (say a MLB game), it is much more likely that if it did go to court the plaintiff would win. Second, YouTube has taken all of the steps to be protected under the DMCA safe harbor provisions (such as register an agent with the copyright office). If you do not take those steps, then there is no protection for you. Also, the funding model behind your site can have a huge impact on what becomes infringing and what is not.

    Here is a pretty good article explaining the theories from both sides. It's not complete, but it gives you a good start.

    Is it legal? Nobody is sure, because it hasn't been decided. There are good arguments on either side and it could come down to which judges review a case first.

    some of the copyrighted video doesn't allowed people to embeded their video.
    But other, I think it is fine.

    thanks for the link druidelder very informative.i guess what it's saying is that as long as it's in html form it's actually not infringement,since it's not being downloading from one of my files.

    besides i know google owns youtube but wouldn't it be good for them if i put a link from youtube on there? that's backlinking isn't it?
