Raffles and the USA

    Was thinking of making a online raffle site and then i read on wiki that raffles are illegal in most of the states of America, but due to the raffle being made by a UK resident are Americans able to play in the raffle? What is the legal issues behind this etc etc

    You can certainly host it outside the US and do whatever the laws there or in the UK allow. But how are you going to get paid?

    And do keep in mind that even if you manage all that and allow US residents to play you might get the same reception that the guys from netteller did when they visited the states. I don't think they are serving any time. I'm pretty sure they rolled over and took it. Well you know where they took it. I don't really have to say that do I?

    I believe the UK's 2005 Gaming Act calls it 'remote gambling' and requires that lotteries be licensed.

    Provision of unlawful facilities abroad
    A person commits an offence if he does anything in Great Britain, or uses remote gambling equipment situated in Great Britain, for the purpose of inviting or enabling a person in a prohibited territory to participate in remote gambling
    In subsection (1) “prohibited territory” means a country or place designated for the purpose of this section by order made by the Secretary of State.

    well the user wouldnt have to pay, would this still be classed as gambling? Also why the hell is raffles illegal in USA? lol
