Quotes and Stories COPYRIGHTS?

    There are many sites that lists quotes & stories written or said by others. If i wanted to start a similar site, am I allowed to take these quotes/stories and put on mine without changing them and keeping the author's name?

    Appreciate any advice. Tks.

    I would be interested in knowing this too. I also find some good comments from users on some blogs or different sites. Am i allowed to copy that comments providing i keep the author?

    The only time you are allowed to "copy" something another person wrote is if you ask for and receive their permission.

    I thinmk you would need to obtain permission from the autho of the qoute or story. Aswell as this you would probably have to say where you copied it from what date etc. But you will needpermission i think

    I wonder though, will some quotes be considered in the public domain, since so many people know them. I'm assuming that any quote by a person who's been dead for more than 80 years would also be free for any use, since I'm assuming that it would fall under the same rules as any book. I'm also guessing that presidential speeches and remarks would fall under public domain, since I don't believe that anything said, done, or produced by the government can be copyrighted. Interesting issue at least.

    There are also times you can use current quotes without permission under the fair use doctrine. However, adding ads to a site might remove any fair use argument.

    Guideline for fair use: (a small percentage of the time fair use is cut and dry, the rest of the time it can be hard to be sure until a judge decides one way or the other)

    the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;

    the nature of the copyrighted work;

    amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

    the effect of the use upon the potential market for or value of the copyrighted work.

    Fair use is never 'cut and dry'. Although the law makes provision for it, 'fair use' is a defense. Each decision in re fair use is made in a courtroom, by a judge. So, in order prove that your use was 'fair use', you'll need to hire an attorney and be ready to pay him/her as well as court costs, penalties, and damages should you lose. There aren't a whole lot of people who seek advice in forums (rather than from an intellectual property attorney) who are ready to take that chance.
