http://downsoft.webcindario.com/telecharger-emule.html Was a link on my site, which looks like it is selling freeware software. This specific page looks to be selling emule and most likely advocating illegal downloads. Is this kind of thing allowed? Just take all that weight and put it on my site.
What are you talking about? Its just a download site by the looks of it. What weight are you talking about? I see no co-op ads on that page, also why should you get the sites weight even if page wasn't allowed and co-op ads where running?
was joking about the weight.. i dont see any ads running either, but he is still getting ads pointed at him, I thought the whole point of the filter was to keep our sites from linking to bad neighbor sites? I don't know what language this site is in, but if you click " Télécharger Emule " (assume Download Emule) you get forwarded to a site that wants you to buy a subscription to download programs. Just my take on it...
Yes, it's french and it's a pay-per-download website. There are a lot of those websites in France, you send a SMS and then download the program. In Spain and Portugal that is starting to get popular too...

what would worry me is that the site is not indexed in Google even though it had been in the past ...
From what I can tell from the site (which I admit isn't too much, as I do not fully speak the language) it's not doing anything illegal. If someone can prove otherwise, that would be a different story. It is also ok for him not to be running ads on the site but to have a link pointing towards him. The site was approved by the reviewers, and unless there was a bait and switch, i think it's fine.

Right but when I go to http://www.archive.org there is a 3 year record of the site. if they are not in Google, could it be that they have been penalized
