On my new site, I have it set up where I place other peoples articles on my site...but I provide a link back to either the originate site(or if an article site to the main article) Can I get into trouble for this? Can I get sued, or will they ask me to remove it first or what? I have it stated on the site that I do provide links back to the owners site, etc. I doubt I will get into trouble as with all these other sites that rip crap and they don't get into trouble from what I can see. I'm not intending on "steeling" anything. Just providing stuff that I thought was interesting on my site. Thanks.
Yes you can get in trouble. Yes you can get sued. They will usually ask you to remove it first, but they do not have to. I've gotten publishers' Adsense accounts banned, sites shut down, etc. for copying my work, and I don't always give them notice (usually I give 48 hours though - depends how much they stole) - if they broke the law they don't deserve any consideration as far as I'm concerned. So yes... you can very much get into trouble if you piss off the wrong person. While most of us don't sue, there's a lot else we can do about it (have your host remove pages or shut down the site, have your Adsense account revoked if it's showing ads with stolen content, have your pages de-indexed from Google and other SEs, contact your private advertisers or other ad networks, etc.). NEVER steal work - and YES that's what you'd be doing. People really need to get it through their thick skulls - giving a link back doesn't make it legal!!! Only use articles from article sites whose terms allow for it. Only use articles from private sites if that site's terms allow for it or if you get private permission from the copyright holder (which is not always the author, and which is not always the site owner). Note that having an RSS feed does NOT mean that you have the right to publish someone else's work - that work carries the same legal protections. Always read all terms on any site - some sites even have it included in their terms that if you use content from their site you're agreeing to the site's terms that they can invoice you (usually for a very large amount) for the reprint rights to that content.
I agree with Jenn. You MUST get permission to use the article on your site. In my experience, most writers will allow you to use the articles with permission from them and whatever credit they want you to include. It is ABSOLUTELY copyright infringement to reprint someone's article on your site without permission. They have no obligation to warn you to take it down before they drag you to court either... I', getting permission right now from 2 people, out of the 3 sites. Reason I do have them published though, but my site hasn't even been advertised. I have 1 person I can garente that will give me permission so that leaves 2 sites. Another, is a 50 50, and another already gave. On his site he says you must link back. NO need to get all aggressive though. That's why I asked so I didn't break the law...It's a paint though getting permission for everything. Though, some stuf I can just retype up my self. I don't have adsense ...I don't display any adds. Here's a question though. I got the WWE Title histories on my site. It's right from their site, and I left everything in contact. Will they do anything to me? Ive contacted them several times about getting permission, and no response...Should I just retype it out or what?
I certainly wasn't trying to be agressive, just wanted you to understand the law. I would not use the WWE histories without permission. Go ahead and rewrite them without using the language that they currently have. Deena
If you're saying that you already have them published (advertised or not), then you did break the law. So no need to act all innocent about it either. I'm a content producer, so yes, I'm aggressive about this topic and all of the louses out there who steal my (and others') hard work. If you can't get permission from a company (they have no obligation to respond), take it down.
LOL, the site isn't even accessible... And no I now have everyone permission except for 2 sites...I got permission from even more just by contacting them. They told me to use what ever I want just as long as I provide a link back to them in the article...and the would like another one somewhere else on the site.... I'm not acting innocent at all. I don't use aggressive words as I have a poor vocabulary and don't want to use a word the wrong way. I have an Uncle who is avid in knowing laws(including copyright) and he's been trying to explain it to me but I get all confused. I will take down the WWE stuff...I got permission form somewhere else to use theirs. So I'd like that better. Although, I can't take it down right now as I'm on a different pc, and have no access to my information...about an hour my PC will be done scanning and I can do so. And I don't steal. I been getting peoples permission over the last 24 hours. I guess you can say steal, but my deff of steal has happened to me. I do GFX for fun, and I had someone claim ownership of them. They where re-uploading them and everything. I threatened them that I would contact the host, and they took them down...That's steeling. They didn't even link back to my old forum where he got them from. He was even posting them as his own work.
