Does a company with TM which includes an exclamation point have rights to domain with same words but without exclamation point? For example if TM is xwz! 123 and I own domain xwz123, can they claim it. Also if TM with exclamation has TM specifically for widgets and I show images and affiliate link to website with competing company's widgets, am I at risk?
The answer to both questions is yes. Without knowing more it is hard to say definitively, but what you are describing sounds like textbook trademark infringement. The fact that you seek to use to sell a competitors products makes it almost assuredly a violation. Why would you think this is not infringement?
