question about eBook title

  1. #1
    a person in my niche has a similar title for his eBook as i want for my eBook.

    the title isnt SUPER specific enough to where it should cause any branding problems (i think anyways).

    would i be in any legal danger giving my book that title?

    It depends on how close is to his.. can you give us both? Im sure you can come up with some thing different if your ebook is good enough?

    theres actually own an apostrophe separating the two titles, haha.

    if i got it trademarked, would i be in 'safer' waters?

    The thing is, all titles are automatically trademarked I believe, just as written works are automatically copyrighted.

    I recommend choosing a different name for your ebook. It's not worth the possible legal troubles and inadvertent loss of customers to your competitor. If your ebook is any good, it deserves a unique title.

    i',m pretty certain that a book title is not automatically trademarked...especially when it contains generic language.

    Now oviously, titles like seo for dummies would be a ip infringment but a generic title like 'Seo for the web' would be near impossible to obtain rights for. Just think about how many books with exact same title abound. Run a search on amazon for a common name and you might see 20 exactly same titles by different authors.

    just my 2 cents...im not a lawyer etc

    Check how many similar titles are available on the market - there is possible that this title is so common, so you have not to worry...
