These include an injury in a traffic accident, injury due to use of faulty goods supplied by a manufacturer, an injury while playing around in the ground or anything of that sorts. Even hurting your ankle while walking around would also account as a personal injury. A personal injury resulting in death can also be put forward for claiming the promised amount by the next of kin of the victim. A personal injury could be physical and/or psychological in nature. Thus it is evident that personal injury claims have to cover a lot of areas. Thus the schemes offered by companies are also very complex. There are a large number of clauses which a person who is taking the scheme should read properly and understand beforehand so that there are no hassles in the future when you actually need to make a claim. There are some immediate steps which you need to take immediately after you suffer a personal injury. The steps to be taken would be dependent on the type of personal injury as follows: 1. If it’s a road accident then the local police needs to be informed. Also it needs to be informed to the insurance policy company. Some policies are void if the incident is not reported to the company. Although your first priority should be getting the immediate medical attention or first aid which may be vital in some cases. 2. If you are injured at work then this should be recorded in the accident book at your workplace. Your employer has a responsibility to inform the local department about it and can be prosecuted if he/she fails to do so. 3. If you receive injury due to some police activities then you should opt for legal advice from some professional on this issue. In all cases the injury should be reported to your doctor. This is because you might require medical attention at that point of time even if the injury is minor. Also when you make claims for the injury in front of the magistrate then your doctor needs to submit a medical report. Also try to gather evidence of the incident in which you have suffered injuries. Try to get some photographs of the scene so that you could produce them later to get claims. Making a complaint is a long and time consuming process and before doing that you should first have a look at the maximum time limit before which you can make a claim. Thus rather than complaining you can indulge directly into claiming procedures. There are a number of ways of getting claims for a personal injury. They are as follows: 1. Using claim Assessors:- Claim Assessors or claim managers are ready to take up your cases on `no win no fee’ basis. The claim assessor may not be a solicitor and thus you may not be able to get claims through a court. Also the claim assessor may ask you a fixed percentage of the compensation as his fee beforehand. Thus you must be ready for paying him a huge amount if you get a healthy claim. You should also check whether the claims assessor is recognized by the government and is following the set of rules that are prescribed for them. 2. Taking Legal action:- If you want to take legal action then you must do so inside a definite period of time as there are very strict restrictions on the time between the injury and the action. In this case you need to consult an experienced solicitor who has worked on these types of cases before. Legal action may prove to be an expensive affair. Thus you might be thinking of insurance policy that also covers for the legal expenses that are incurred during the claim procedure. Although, if you lose the case then you might have to pay the legal expenses of the other party. 3. Claiming through Criminal agency compensation authority:- If you have received an injury due to a criminal act then you claim compensation through Criminal Injuries Compensation Authority. In this case you must be quick in applying for the compensations. The injury could be an injury which you suffered while helping the police or as a victim of a criminal act. Children who were abused can also claim compensation. Generally the time limit is two years and can be extended in special cases. 4. Special Compensation schemes: You might have contracted HIV virus while receiving treatment for haemophilia. In this situation you can make healthy claims for your treatment and for the lapse in treatment procedure that you have suffered from. All the above said schemes need to be duly considered before choosing one. You can take advice for choosing a particular scheme from a local advising agency.
