Site like youtube and even rapidshare itself are not equivalent to a site where the owner puts up links. Those sites are based on user submitted content and as such get special protection. Sites where the owner puts up infringing content get no such protection, nor does the protection of the original site extend to your site. The PirateBay is also fairly unique because it is owned and run from Sweden which already has case law on this. The US does not have strong case law on the subject yet, and nobody can tell you how that will turn out (decisions have fallen on both sides so far). For those that think that not hosting infringing material or that simply having a disclaimer about infringing materials (and then ignoring it) is sufficient to keep you out of trouble, you should research the Grokster case. They did not host any material, yet they got shut down.
OK so putting up direct links is illegal. What about linking to sites/forums that are linking to rapidshare/megaupload/etc links that may contain downloads for movies, games, etc?
If some community having this links and users are adding those rapid share link..... Moreover community disclaimer say : We are not responsible for the content added by the users... That would be a big loop hole for any of the laws....or is there any provision for communities also there.. In any social network like ORKUT or Facebook there are thousands of people adding and distributing this kind of links...
