Hey Guys, I recently purchased Foxadder from Foxadder.com, it was just a dollar with the use of a coupon, so I thought meh what's a buck and grabbed it, a day later (or a few hours later) they have charged my card again, I was spitting chips as I thought it was just $1 .... So today I contacted them - before I commence action - and they say that they charged me for updates to the software, $20 per update they charge, so they say they've added 3 components and that's why it equaled $60. Now they can charge me whatever they want, whenever they want, when ever they update - it's BS. They claim that I have agreed to their t & C, and I have to pay them for updates, I had no idea of this, I can't even access their website or find a way to un-subscribe - apparently the email help guy will stop the subscription to updates. here's some information on them from others caught by this trap aswell : http://www.thetoolsmith.com/forum/viewtopic.php?f=5&t=4663 Several people with same issue here : http://answers.yahoo.com/question/index?qid=20080331230851AAAUq3F&show=7 So what can I do, I purchased with a debit card -so we have taken out all the funds, so hopefully no more can be accessed or taken. Can I charge back and get my money back ? Are they obligated to refund cash ? Do they need to provide a exit from their contract - legally ? Are they required to make us aware of this commitment and if so how clear ? Any help is appreciated.
Contact your credit/debit card company, explain that these are unauthorized charges, and (likely after investigation) they will reverse them.

Lame. Be careful at that joint, and if that link works for you - sweet as you have opted me out !
Thankyou heaps for that, I have had to cancel my card, block his access to my account, and then he wont respond to my emails when I request to opt out - then today he has the cheek to send me the updates again - which means 3 more updates and another $60 - if he can still hit up my account.
This always happen to ppl who never read T&C. Also they have the right to charge you since you accepted to register. For any dummy is very clear that somewhere will be a glitch, come on... just one dollar? It's very clear that somewhere will be any hidden charges but not very hidden, somewhere on their TC they warn you. All Updates are billed on or before the 16th of each month. When purchasing FoxAdder you are automatically enlisted into automatic updates. If you choose not to update your FoxAdder anymore then please contact our billing at his e-mail address is being protected from spam bots, you need JavaScript enabled to view it and we will be glad to turn off your automatic updates. Keep in mind if we turn off your updates you will no longer be eligible for updates unless you re enroll." Sorry to say but you are a dummy not to read TC when you make a purchase online. I might get some negative reputation for my claim on you but this will make others to open their eyes when buy products/services online.

Anybody with a program that needs updates every month just to access some pages/sites that keep disabling their software must be doing something hinky. I've never needed updates to use/visit those sites. Thanks for the Heads up!
Yes you are right, this was a error by me, but still there should be more warnings about this, in their emails there should be a warning, on their purchase page there should be a warning, on their emails their should be a opt out option. The fact they block users and members from their website after purchase with 403s and re-directs is shonky. Then there's the fact the software was updated a few hours after purchase and then on the first of the month (May) they again tried to charge for an update - actually three updates was also shonky. Coupled with the facts that this has happened to several people in the past few months is also dodgy. Either way I have had no dramas in reporting and claiming the cash to be refunded through my bank.

It's purposely hidden inside the "miscellaneous" part of a TOS...which you get only a link to on the checkout page which more than likely is distracting you from reading it. Sorry but this is just a scam. The $1 bait and switch and then $80 PER MONTH for crap updates. That's $1000 a year if you aren't paying attention. Total bogus. They should be investigated for fraud and their CC billing company should shut them down. Hopefully enough complaints and chargebacks are given that indeed they will be shut down. Credit card companies HATE chargebacks.
Yup ^^ it's a well planned scam .... Only way out is to cancel card .... no response to my emails and requests to cancel. And I bet my left nut that there are no updates each month or after purchase, they start by sending you the original script, then periodically they will send a update link to already updated software. All they need to do is change a letter within their script to claim an update, for instance they could say "we fixed "asshole" with "Asshole" and "Sucked in" with "Sucked In" - they don't claim what they will update or what update you pay for.
Actually im not sure where your from but in the UK you can have trasactions blocked an immeditaly reversed, If you contact your bank tell them that it is an unauthorised payment, f**k what the t's and c's say it wont get disputed and furthermore the vendor will have to provide proof you agreed to them, but that happens AFTER you get your money back also, remeber once the charges are reversed tell your bank that you do not want to accept anymore charges from this company/user the bank will then refuse any attempt to take any further funds and you will not need to have your card blocked/renewed or have your banking information changed.
