Yes, you can put on a disclaimer, and you normally will be covered. However, if it happens often, law enforcement will investigate.
Even if they investigate, having a proxy service is not illegal. And if you have the disclaimer, I think you should be fine.
You won't get in trouble, I am just saying chances are, which are very HIGH, your proxy may get shut down, but that is unlikely.
