Property Damages

    I rent a business unit and a week ago we had a water leak in the toilet and there was an ample amount of water soaking through the carpet. The tenants arranged for a plumber to fix the leak in the toilet within a few days but the carpet is still soaking and the unit stinks of damp.

    Would the tenant be responsible for replacing the carpet as well as fixing the leak?

    I think that you have got mixed up here, the landlord of the property would have to sort out these issues, there are strict laws on people looking to rent out property.

    As for a smelly carpet, might be more realistic that the carpet be cleaned professionally rather than get a new carpet placed down.

    If you are paying rent to the owner, you are the tenant. The laws vary by location, of course, but this sort of situation is usually taken care of by the landlord - both hiring the plumber and fixing any water damage.

    Usually the insurance should cover if not the landlord.

    Just ask the landlord to hire a carpeting cleaning service... (and note the urgency)... today it can be simply a bad smell, tomorrow in can be health related problems from mold spores.

    Carpet fibers aren't just a singular developed material... some mold can be very harmful to humans. There are more than 100,000 types of mold and varieties of black mold can be particularly harmful to everyone's health.
