I would like to learn what others with web stores are doing regards product liability insurance. In my case, all products will be dropshipped. Is only the product maker liable for damages or is the internet seller also liable? Are you protecting yourselves and, if so, to what dollar limits?
I would have basic buisness insurance. as far as product liability, the manufacturer is ultimately responsible, but anybody van sue you too if the decide to. This should probably be in the Legal Issues section.
The claims most commonly associated with product liability are negligence, strict products liability, breach of warranty, and various consumer protection claims. The majorities of product liability laws are determined at the state level and vary widely from state to state. Each type of product liability claim requires different elements to be proven to present a successful claim, hence for internet selling you should go through with its particular legal database and it is advisable better to consult your lawyer.
I agree, consult your lawyer. You particular products, location and a lot of other variables will affect what kind and how much insurance you need.
