Problem on dispute

    Hello guys,

    We have had a client who paid us a lot of money on the last month for a PR campaign, to get some publications on the big outlets, etc.

    The problem is that you never know exactly when you get the results there, so after we spent and waist a lot of time with our journalists and connections because we have exact terms and conditions (PR projects are hourly paid + we do not guarantee placement), we got some disputes today from the clients.

    The agency opened now 2 disputes and probably will open the other 5 too.
    What are the chances that they can win?! The amount is aprox. 27k?

    If they paid you via Paypal.....good luck...

    I would suggest trying to appease your clients before things get worse. Also, beside losing the money, a happy client means more referrals, instead of bad feedback all over the web and bad words to other businesses about your service.

    I know that, but a contract remains a contract. We have a 6 month deal and after almost 2 months we got this!? Many "business" people started to get. They start the contract and after a period they cancel, pretend the money back! Is this normal!? Is this how a business should be done!? I guess not.

    As a part of review and defense our rights, we called paypal but everybody knows about services and 45 days stuff. In 8 years we never had issues, but sometimes you cant control something like that.

    If it was a digital service you have a shot at winning, especially if your contract specifically states that there isn't any specific guarantee on results for the campaign. However, if they paid with a credit card through paypal, they will have a second chance to request a chargeback through their bank if paypal rules in your favor.

    It might be worth requiring wire transfers in the future for large invoices on clients that you don't have a long standing relationship with.

    Well, true. We called the paypal and they confirmed this aspectes already. Plus the company paid with funds from paypal not cc.

    have any of your clients had any positive results? have you clearly explained to the clients the current progress? Surely 2 months in should be some results to show, and you can promote what they can expect if they continue the contract.
    When they signed the contract with you, did you have any sort of exit clause? Can you ask whoever drafted your contract(s) to contact your clients, advising them that if they cancel the contract, they are still legally liable for the full amount of the contract.

    You should have seen my last phone contract. Try to escape and you still have to pay the contract in full + exit fees + any fees associated with chasing your payments. So if you have a contract, dont worry about paypal, as even if paypal refunds their money, whoever signed the contract is still under a legal obligation to fulfill the contract.
