Premier League a trademark?

    Have been looking round the Barclay's Premiership official site but have not found any mention that "Premier League" is a registered trademark. Their terms and conditions refer to "Football Association Premier League".

    Also, if "Football Association Premier League" is a registered trademark, can you use a substring of that trademark (such as "Premier League") without infringing copyright/trademark law.

    To me the phrase "Premier League" seems quite generic, but I am no lawyer.

    Has anyone else here registered a domain with "Premier League" in it and had problems?

    I wouldn't if I were you. The Premier League is a very rich organization who earn money through the goodwill of their trademarks. They should have armies of lawyers helping them maintain and protect their copyrights. I had once wanted to built a web site dedicated to my favorite team, but after looking at all the potential troubles, I decided it is totally not worth it.

    There are many non-infringing uses I can think of.

    The real question is what is your purpose to use the name? If it has anything even remotely to do with Football, then it will be infringement. If it is related to something unrelated like fish bait, then you are probably okay.

    Usually the very reason people seek to use a trademark or related term is to capitalize on the existing trademark's good will or popularity or to compete with it directly. Those are all infringing uses.
