While at a recent kids basketball game, I was recording the game on my video camera. The lady next to me stands up and shouts profanity. I turn my camera and capture the rest of her tirade. Do you need her permission to post this on You Tube? My thoughts are that we are in a public place. She knows I'm recording. These things would give me the ability to post this video. Any help on this topic would be appreciated.
I'm not a lawyer but you were filming a kid's basketball game which i suppose wasnt illegal, depending on the policies of the owner of the place concerning videotaping, but otherwise you didin't disturb her privacy and you were in a public area.
Just because you happened to "accidentally" look at her with the camera while you were looking in the bag next to you for the candy bar......see where I'm going with this? But this is something that depends on where you live, if your in the US, different states have different laws concerning who has to know they are being taped.
its safer as you were in a public place and the lady was obviously aware of what you were trying to do with the camera..however, you can never be sure as to what her side of the story might be..so better safe than sorry
Yes normally you need her permission to post it. But whos care,just post it up,she will not even view your upload videos.
It is correct that every state has its own laws. You have to google your state laws to find out. Some states require you to gain the permission of someone if they are recognizable, before posting it by any public means. Other states have very strict laws on posting any videos or pictures that have minors in them without consent from their parents. I would check out your state laws just to be sure so you dont get into any trouble.
You can post without her permission but if she saw the video which post it on you tube and if she decided to take legal action then she can claiming and also there is a law. Recently some people sue Google map because of the satellite views. This is something similar.

She clearly acknowledges that you have her on camera. Personally, I think you're in the clear and I hope your video becomes a viral sensation so everyone can see that this woman acted like a foul-mouthed pig while at a Catholic girl's basketball game. You may also want to put on on sites that will pay you. I think MetaCafe pays about five bucks per a thousand views, but I don't remember the other paying sites right now.
NO.... she can sue you.. however, she has to ask you to take it down first before she can sue you. But she needs to know. Or take a risk until she finds out.
Wow, she is freaking out. She clearly sees the camera, she would have said something about you taping her in the first place.
How do you let her know when I have no idea who she is? What are the penalties.. It might be worth it!! lol.
I have posted 327+ videos to date and I do not ask anyone's permission to post up on YouTube. My thoughts are we live in a society where you could be on camera at anytime. I think you need to be cognoscente of your actions at all time knowing you could be on video. i.e.: I took my Flip Mino to the Cheese Cash Factory to video my wife's birthday, did I ask everyone's permission to post to YouTube, heck no! Most people are flattered to be on video and get their 15 minutes of fame. With that lady, she should have watched her language in a public venue. That is my opinion.
