If I tell someone to do something on my website and they get hurt doing it, am I liable to get sued? Thanks in advance.
Yes and no.. I've heard of some people trying to sue websites, because they told them to treat a certain ailment in a certain way, and it didn't work. So it is possible, yes. The answer: Putting up a disclaimer on the site. This will cover your ass, in case they try to come back and say it was your fault. (Even though that'd be retarded..) Something along the links of: "All information contained on our website is intended for informational and educational purposes. The information is not intended nor suited to be a replacement or substitute for professional medical treatment or for professional medical advice relative to a specific medical question or condition." If you're still worried, talk to a lawyer. They'll tell you the answer, guaranteed.
My best advice is to mention on your website. Do it at your own risk. I do not know what you want to suggest to people, but generally you should adopt of certain code of conduct. You still have a basic responsibility. You can even ask people to check an option before viewing the documents or videos. The option would says: "I agree to not hold liable YOUR WEBSITE and I am responsible to judging and using th information found at YOUR WEBSITE.". Be clear and honest, it will be harder to hold you liable.
there are very well written lawsuits for personal injury in USA. you can see site in signature for more information.
I think you will be held liable for the injury caused.. I believe giving out false info is one that is punishable info.. I just can't seem to depict the exact provision of the law that punishes the same.. However, it is really hard to sue people who violates the law online.. This is so because internet info can easily be fabricated.. It would be good if the one to be sued placed his true name and address.. But what if he did not..?? Does tracing the IP address help..?? What if the offender is not within the jurisdiction of the court where the action was filed..?? I am from the Philippines and our laws do not have sufficient provisions to cover such defects.. I'm not really sure if American laws have provided for these instances..
