Please help with Escrow.com - Cancelling a transaction

    Hi guys, I need your help here :)
    I have bought a website and I and the seller decided to use escrow.com
    He initiated the transaction, but they rejected my credit card payment (the only way I had to pay) because "Escrow.com is unable to accept a credit card or PayPal for transactions involving website content, software or data. Please choose another payment option. Thank you,"

    I figured that if he just initiates another transaction as a "domain transfer", without mentioning the website content they would not reject it (done it before), but now, can he cancel the transaction without me having to pay escrow fees?

    Please note no payment has been sent, we have just agreed to the transaction but no money transfer has taken place. Escrow says in the transaction info:

    "Escrow Fee to be paid by: Split
    The buyer is responsible for 100% of the escrow fee in the event
    the transaction is cancelled or the merchandise is returned."

    Question: If we cancel the transaction now, do I (as the buyer) have to pay the fees or does that happen only if I have ALREADY paid?
