Hi, I parched a domain from godaddy auction (that was a domain of hotel) after purchase of this domain I get contacted via phone by previous owner and he ask me to push back that domain I was ready that time to because I bought that domain in $80 and I have created a small site on that so I asked him to give me 150$ for that domain (Because that time I didn’t use that domain into my business as well I didn’t done much work on that) But that time he didn’t respond on that. After that just 1 month ago (after 11 months of register that domain) I got a mail on behalf of that person (He told me that he is the friend of previous owner) that can I push back that domain. I denied that time because I have invested my money in to that because and now it’s ranked very well in search engines from very competitive keywords(I think main reason of now they want that domain again). After few day’s I got a notice from there end that they file a case at WIPO to get back this domain that I am misusing that domain and some other like trademark (Which is not correct). Now today I got mail from godaddy that So the main problem is I don’t face this type of problem in past so I don’t have knowledge that how to respond in this matter. And how can put my point of view to defend my domain and Where. Any help will appreciate to solve this issue. Thanks
Well, if your domain is a trademark or like: hotel-name_com/net/tld they might have the right to sue and probably lot of chances to win this case. Try to keep us noticed on this issue as I am sure many will go through a similar situation in future or even at the present moment. Rob
You should have received a notification of the dispute with additional information from WIPO. It should have been sent to the address listed in the domains WHOIS info. That will tell you the deadline for filing a response and the specific allegations you need to refute. Here is the official FAQ about WIPO domain name disputes: http://www.wipo.int/amc/en/center/faq/domains.html#c http://www.wipo.int/amc/en/domains/filing/udrp/index.html http://www.wipo.int/amc/en/domains/ It has links to information about how to file a response. You need to decide whether it is worth it to respond. Here is are the criteria they use to judge the dispute: If the domain contains the name of an existing business, you may have problems with (i). Also asking for $150 could be taken as evidence that you registered the domain in bad faith, so you may have problems with (iii). If it's important to you, hire an experienced attorney to help you through the process.
And unfortunately, that's really the only feasible option here. And to the OP, you might want to check if you've been charged $29 by Go Daddy for this.
