Please help!! A simple question!

    Hi
    I'll just go straight to the point
    my dad is under a lawsuit (a ridiculous claim in my opinion) but I want to know what would happen if worse comes to worst
    Basically, the store my dad owns apparently caused an environmental damage to the land it is currently sitting on...
    The landlord wants my dad to pay $25 million for the damages it has caused...
    We don't have such money and I think they want the insurance company covering my dad to pay for this...
    (I also think this was a setup since they forced my dad to get an insurance company and revised the contract so my dad is liable for all the damages to the property right before they sued us)
    But anyways... Obviously we don't have $25 million to pay (if we did, we wouldn't be running a dry cleaners :p) and I'm wondering what would happen to my dad if he was found guilty of the charges and if the insurance company refuses to pay...
    Does he simple give everything he has and declare bankruptcy? or would he go to jail for not being able to pay up??
    Btw i live in Canada (not sure if the laws are different from the states)

    Please give me some advice or answers~

    Unfortunately that's something only a Canadian barrister can accurately answer. What you said is one possibility,
    but no one really knows except the judge hearing the dispute and any barrister or lawyer within jurisdiction.

    For something this serious I have to say you need to get professional legal advice.

    At the very least you should find a legal forum to post on as there may be people more qualified to offer advice in one of those.

    I hope it all works out for your father though.

    You are asking for high end legal advice on a webmasters forum ??? you also mention that you live in canada but as a premium member it shows the true country that you live in as Hong Kong so not really sure what to think.Seek a person who has legal knowledge of that area,no point asking for help from another country as they could well have differant laws.

    unless there's a lawyer here who knows who has practiced canadian laws, no one will be able to answer you. with luck you'll be able to have this question answered on a forum that's based around canadian law. being a US citizen, i personally don't know any. Give it a Google though, perhaps you'll find one.

    best of luck though. sounds like a crazy situation.

    In no form or fashion am I a lawyer but I do know that this case sounds completely unreal and ridiculous. How on Earth could the damages cost that much? Does you dad own the store and land, does he own only the store, and who owns the land? I honestly think that he is just trying to sue because he needs money, because there is no way that much damage could have happened to the land. I mean it's not a farm and crops were ruined by your dad.

    is essentially a civil dispute with another, that's what lawyers are for.
