So if you search yahoo or google for an image, is that image considered public domain if it doesn't have a trademark or copyright?

Any image belongs to its owner. Period. You need his/her permission to use it.

Wikipedia has a list of public domain image resources:

    http://en.wikipedia.org/wiki/Public_domain_image_resources

Just to be safe, it's best to check the terms and conditions of the site with the image you are interested in using. You can assume that the images are NOT in the public domain unless the site explicitly says otherwise.

Google states the following on their images search results:

What you need is stock photos and I am guessing for free? There are sites out there that allow you to use photos for free and some sites require a license.

Pictures from Google and Yahoo image search results belong to their owners.

As the image search result states anyway

Theres a lot of information about free stock photography at:

    http://www.free-stock-photos.info

FAQs, etc. that will answer some of these questions. You can't use google images legally, for the most part.

Well, depending on the image, the person can:

    1) Sue you
    2) Charge usage fees
    3) File a DMCA complaint with your host and all major search engines thus effectively shutting your site down.

Best thing is just to not use someone else's images without their permission.

Somewhere on the page containing the image or on the site itself it will have a notice stating that the image(s) are in the public domain.
