Hello, I have an idea for my new service, I want to start service with adult photos of knowed actresses, singers etc... Can I just put someone photos on my site and make the photos aviewable after buy an account ? Thank You! Ernest Musial.
The short answer is NO! Unless you have taken the photos yourself or have bought the rights from the original photographer you will be in violation of image copyright. If the copyright holder finds out they can sue you for infringement (to a max of $150 000 per image [US Law]) They can also have your site taken down and removed from search engines.
but If the images are hosted on other servers and I have just copied the address and placed on my site ? Or if it is scanned from some magazine ?
It will still be copyright infringement. If you link directly to the image (e.g. it shows up on your site) you are also stealing bandwidth from the original site. This will get the webmaster of the original site on your tail very quickly and could get them to change images to display porn or some other nasty image on your site instead of the image you think you are linking to. All images in magazines are copyrighted to the magazine or to the photographer, so you will still be infringing their copyright as well.
ALL works (except those in the public domain eg. published before 1923 etc) are copyrighted as soon as they are fixed in a tangible form. There doesn't need to be a copyright notice, but they ARE copyrighted.
