Personal Use License and Resell License

    I had a site and it had personal use license, I wan't aware of it and listed on auction site.
    Now the owner some how found me and trying to test me.
    I have though subsequently purchased the resell rights license while the auction is still listed, and not yet complete.

    The Personal use license said that "[No] You Cannot sell on Auction Sites"
    The resell license obviously says that "[Yes] Can be offered through auction sites"

    The owner is saying you didn't have right while listing, my point is I never sold it yet so there is no breach. And now that I have the resell license I can sell it.

    Owner says you couldn't even list it without resell rights.
    So what is the legally correct option here, am I safe, the vendor/owner is asking me for xxx$ and not settling for truce, while the auction site has given me go ahead.

    Is it legit to list with personal use, in the interim before auction is over buy resell rights and sell it.
    As the personal says not to sell, doesn't talk about listing.
