People stealing my content.

    I have had a lot of trackbacks in my blog from idiots who post my content on their sites... they give me credit but they still post everything found on my site. Can I sue?

    Nope.. But then again, it depends. Are your contents all copyright exclusively to you? Do you yourself have your own exclusive license? If they are giving trackbacks and all, then I honestly feel that you should mail that blog's owner and tell them that you don't want them to republish your contents. Since they are providin trackbacks they most probably don't have the intention of stealing anyway since they know that you are seeing their posts... ..and it happens to me all the time, I feel that at least they are linking back to me, most people wont even link to you at all. So its all good as long as they provide a link back and don't link my downloads directly.

    I would suggest you get a lawyer to shoot out Cease & Desist letters to all those people who are stealing your original content.

    I have a full time professional content writer who works for me. Am i to assume that the content they write for my company is copyrighted to us by default?

    nope...did you have them sign a contract with you...if not then the original author owns the copyright...

    Interesting... So if an employee works for us writing webpages then they own the content because they are the author and not the company.

    P.S. Empolyment contracts hold no information pertaining to copyright ownership.

    As far as I know blogs are made for that, let other people replicate their content giving credit where credit is due, otherwise you should better work on a website which is the only way to limit a bit people grabbing your original work.

    Employment contracts hold no information pertaining to copyring ownership? Perhaps...but you know at every one of the last jobs I have been employed in I had to sign something that said that they own everything that I work on on their computers or during their time...perhaps it is just in my field, computer programming, but it is common...Often it is on the "Conflict of Interest Policy."

    In addtiion, the copyright is owned by the employee automatically on creation, unless you had them sign something...If you have employees working for you...you probably should have them sign something that says you own everything they create...

    But you don't have to... A publisher makes the author sign something...you are a publisher on a website...

    This is called 'LIFE' - your content will be stolen regardless what you do. I assume you are using WordPress, if so, there are steps you can take to limit this, slightly. "I'll fucking kick your head in, you piece of shit" - that e-mail will do nicely, shoot that off to the leechers. LOL.
