penalized domain with many removed urls

I have a domain which is penalized by google with around 50 odd pages removed from google (dmca) including homepage. Will google reconsider if I remove the entire site and come up with a different niche using the same domain ?

Please share your thoughts.. Thank you.

    Yeah
You will come with same domain and this is not matter that you use same niche or come back with different niche. In any condition google will deal you like a fresh website.

yap, they don't care about the outside, only the inside - they don't judge a book by its cover.

You have a fresh website, so old rules will not valid. Just file reconsideration request. Google will consider as fresh.

Yes, it is possible for Google to grant a "Reconsideration Request". However, it's best to make sure that whatever you decide to put up before you submit your request, make sure it's good, quality, original content and that the site looks nice and clean. If you put up something that looks "Spammy" in their eyes then the request might be denied.

once the dirty linens are washed, they they can be acceptable to the public. They will not mind how they were or what was in them but the linens remain. that means that also, google will not mind accepting your old domain carrying new and fresh content. thanks

It doesn't actually matter but may be it will take some more time than expected for your site to be in Good book of google. No one can control on Google as even for a fresh site, all URL crawling takes time.
