Hey, My buddy sells SEO and search marketing courses on eBay and has been doing so for about 6 months. His PayPal account usually receives between $600-900 in payments on a daily basis. A while back, a buyer from Israel reversed a PayPal payment claiming that the product was not received. My buddy did in fact send out the course, however he does not have a tracking number for the package. The Israeli buyer won the claim and PayPal took $750 out of my buddy's account. He is capable of paying it however he is refusing to on principal. PayPal has been calling his house threatening to send the payment to collections. The other day, his mother answered the phone and said he was not there (even though he was at home at the time). The lady on the phone from PayPal started yelling at his mom telling her that she knows he's there, etc. My buddy grabbed the phone and said certain things to this PayPal agent including racial remarks about her Mexican decent, and concluded the phone call telling her that he has all of her personal information (which he does), and told her that if she ever spoke to his mother like that again, he would commit violent crimes against her. I've put that in a very nice way as the original conversation was way too vulgar and graphic to post on DP. Anyways, is it likely PayPal and/or this lady will use legal action against him for the things said in the recorded phone call? - Mike
Maybe you would want to ask your friend to call up Paypal and say "Sorry". A sorry can help dissolve a lot of differences, problems and arguments. Better be on the safe side.
How did they take the money out of his account and then he refused to pay, if they took it out he already paid. Or his is account in negative equity?
They probably hear that a lot, and I don't think PayPal would want to bring it up after what they were saying to coerce that... but it could happen.
Who cares what happens to your 'friend'. He sounds like a real sick jerk to me. One can only hope Paypal takes the criminal threats seriously and he is held accountable. Threatening a paypal employee with violent crimes and racist remarks about the persons heritage - for merely doing her job is reprehensible.
You will probably find that paypal hands out debt collection to third party collection agencies anyway, so the girlie is probably used to loads of abuse so she wont sweat it, dont worry. All she does is when her boss says, "did you resolve the $750 matter with the course chappy?" she will simply play the recording back and it will be filed under "nutters". Its not cool to be rude and make racsist comments though to people you dont know. (well also to people you know its not cool either) Who knows, she may tell her cousin who is in the mexican secret army, who will track your buddy down and "dissappear" him and his family.
Firstly, getting pissed at anyone official over the phone is bad, you want to build a case for yourself if it were ever to go beyond collection agencies. Obviously while on the phone, once you know its paypal, ask them to stay on hold for a moment while you get a recorder, mobile phones often have this feature, then while it is on record ask her if its ok to record the conversation. once thats done talk to her in a calm and polite manner, never raise your voice or be abusive in anyway, no matter what the person on the other end of the phone is like. Keep the recording on file, obviously youve told them to fuck off in a polite manner. This way there is a record you to check exactly what has been said, and this also stops anyone from changing the story. Paypal will have out this sort of thing to third parties, i should know ... they have a collection agency trying to take £200 off me, bare this in mind though. If you win or lose, paypal will ban you from their service for being a real pain in the butt, even if you pay them, you still lose paypal, which really isnt a bad thing. On a final note, moneybookers for the win, you should look them up. Sorry for the aimless rant, i hope some of it was helpful.
For heavens sake do this. What he did was totally out of order. Imagine if this was your girlfriend or mum (no) how would you feel? He has been a shit and your behaviour has been influnced by your surroundings if you support him. 3 hail marys and pay the debitback Why would you be deited back anyway?
Who's not to say this buddy of yours might be you. Own up, Racial remarks is not acceptable and in most countries Under the Race Relations Act, it is unlawful to discriminate against anyone on grounds of race, colour, nationality (including citizenship), or ethnic or national origin. All racial groups are protected from discrimination.
They can't do nothing to you they called you and the lady on the phone had no right to question a response, shes supposed to say "ok thank you. bye". End of story if what you say is really true and she pushed the conversation into escalation by calling your friends mom a liar (or your mom i am thinking) Then shes wrong in this. Although your mom should of hung up by then. They can't sue you for saying bad words to them they know its a waste of time and the lady on the phone had it coming to her if she escalated the conversation. No matter what you did you don't have to tell these people anything fight it in court if you have to, most companies won't go to court if the payment owed is less than a certain amount like 1,000$ or so. you might be an exception though. Either way like someone said your gonna lose out on paypal so you might as well fight it although you have no proof on your side from what i can tell since your out the service you might as well make them fight for your money. No matter what anyone here says about your actions at yelling at the lady these are the kind of people who get bullied into things and most likely if they were called by someone they din't know and demand they had to pay some sort of payment they would without a question because they fear standing up and fighting back. Its not a crime to fight back but if you know that what you did was wrong then there could be a problem. If you did however send the package there is still hope for you on your side of the case.
They won't do anything, because they won't want the public to know their screaming at peoples families, thats not good support, they word gets out about that and many people would drop their paypals. So its ok, its just paypal will get agencies to call for the money and that will hurt his credit if that is important to him.
Because they do debit your account, and you have 120 days to make it a zero balance, or they send you to collections. So if you opt to not pay, and make 0.00 by the 120th day, you are not paying. As for the Israeli not paying, or charging back in this case with your friend. It doesn't surprise me. That is why some processors, online stores, affiliate programs black list that country.
Your "friend" is an idiot. Most of those calls are recorded. And over $750 your "friend" is refusing to accept $600-$900 a day in payments? I find all this hard to stomach.
You sure this is your "friend"? The least worst case scenario paypal will send the unpayed amount to a credit agency, which will ruin your friend's credit, and also paypal most likely will submit this case to a collection agency as well. Your friend is a real idiot and a jerk as well.
