    That's hardly enough information to give you a valid answer.

    Explain the situation more.

    If it is intangible goods, the buyer will win by default unless they've done something to prove they received their purchase, such as, listing what they bought from you on eBay. In that case, the seller would win.

    If its Digital then the buyer will have most of the chance.
