I am developer of website from India and I have done a website for my client 2 months before. Website cost was total of XXXX$. He paid me and everything was fine He paid me using credit card. I knew the possibility that they can do the chargeback. So before uploading a website I told him to fax my lawyer in united states the agreement that he is happy with the website and I have written all tranasaction ids of paypal and written that he will not do any charge backs on any of that tranasactions number. Also in bottom he has written that once the website is uploaded on his server there will be no problems. Now after 1 month from the agreement he signed he calls me and says that there are somethings that were not done correctly. I have shown him the whole website before uploading and after which he has signed the contract and sent to my lawyer. I told him that website was in working condition and was working properly. I will need XXX$ to fix the problems you are saying. He told me that he will talk with his lawyer and will take action. I am not worried about any action but I am worried about charge backs. Do you think such agreement will help me? Please help me
well you can try it . but it wont help much i guess . because paypal are weird people they support always the seller or in other words who gives the money rather than who accepts the money moreover just incase to avoid charge back you can transfer your money to new paypal account and close this account so their wont be a charge back . just an advice . rest is up to you how you implement it ..
Money came in 4 accounts. One account is on hold by paypal and all other 3 accounts are already closed. After account is closed paypal cannot take money?
Did you create agreement about updates, fix error, and technical problem after the website published? I guess you didn't. Anyway, paypal not offering seller protection for digital stuff, so you will loose in dispute. But, the agreement will help you to have a chance winning the dispute.
No in agreement it was written that once the website is published than he is happy with the service. if there any charge back occurs than client will directly deal with paypal member and not with paypal or credit card company and if he places the chargeback than he will have to take care of lawyer charges incur in collecting money...he signed it and sent as a fax to me
Fight brother, you lose nothing... As mentioned, you closed all the accounts, then thats ok. and just as a precautionary measury, draw the money in the bank account which had attached with that paypal transaction. There is always, a choice to load money form your bank,or credit card for the paypal. Till you hold the money safe, nothing can be happened. and I suggest you check the agrement one more time, and scrutinize things to approch. You may file breach of contract, and some legal action, to Save your self. Paypal is an ugly, worst, rubbish thing for the seller. Post your triumph in DP as its an encouraging for many victims for the Paypal. Best of luck
I have withdrawn money for 3 accounts and closed them ...only 1 account is having the money and its frozen by paypal for 6 months so thats why I am worried else there will be no problems. I am thinking of sending him some letter from my lawyer explaining him what can be circumstances because I know once he files the charge back than I cannot do anything because to call paypal and listen to there lame excuse is worst than that. I think once he see that I can take any legal action he will not do any charge backs and will get small changes done from some one else.
That may be a good idea, cut form that side.I wish you success, just think, . You will always have a point to hold, which lead you success. There is always brutes online, do not get discouraged, and post and seek some legal, sites, so that there may be a clue, a chance you will.
well when i had did a similar thing they couldnt do anything because i transferred money in some other account and closed the account . so they cant do anything once you close your account .
yeah thats true but one account is frozen and than they will link all 3 close accounts to one which is open and take all money from it..Thats what my concern is. Thanks for help
