Why GoDaddy.com (or any other registrar, for that matter) cannot get involved in these types of disputes: Any established registrar is bound by the rules of the ICANN's UDRP (The Uniform Domain Name Dispute Resolution Policy). The UDRP prohibits the registrar from becoming involved in any type of domain name dispute between two parties without direction from a court or arbitration forum. The purpose of this rule is to prevent registrars from playing the role of a judge or jury which they cannot (or should not do). A registrar is not a legal body. Can you imagine if it was up to the registrar to interpret agreements between two parties or to decide who had rights to domain names in any kind of domain dispute? That is why ICANN put the UDRP in place, so that registrars are prevented from playing the judge in such matters. Unfortunately, registrants feel that they should be protected by their registrar no matter what kind of shady dealings they might decide to take part in. A registrar cannot be responsible for a registrant's bad choice. Likewise, a registrant needs to take responsibility in a transaction that the registrar had nothing to do with. What you can do to keep yourself from getting in this type of predicament: If you are buying or selling a name it always makes more sense to go through a legitimate aftermarket site (like TDNAM) or an escrow service before committing to a purchase or sale. Yes, TDNAM is an aftermarket site that you can go to protect yourself against fraud. But this is not a sales pitch. This is an attempt to try to prevent others from making the same mistake. You don't have to go through TDNAM. But please, if the domain is worth something to you, or you are paying something substantial, be smart about it; go through a legitimate aftermarket site or an escrow service before committing to a purchase or a sale. As we all know, there are scammers out there. So, protect yourself and watch out. Domain Services GoDaddy.com, Inc.

How is it a dispute when you cannot even contact the scammer who is the current registrant? Especially when the whois info on file is another person's stolen identity. A dispute takes two parties and I am pretty sure that you will not hear a peep from the scammer. Meanwhile, GoDaddy allows the scammer to sell these names to yet another unsuspecting individual, causing someone else to get scammed. IMO, if a domain is reported as stolen you should at least freeze the account so that it cannot be sold, and sold and sold again. What if 30 days down the road I do get a direct order from the court for GoDaddy to give my names back? And the names have already been sold by the scammer to another person. That person will be out the money and the names would be returned to me. A situation that GoDaddy could have prevented by freezing the domains from being transfered. I didn't know that using DP and other forums was considered "Shady Dealings" and a "Bad Choice". Your current "rules" allow for scammers to take advantage of registrants that use GoDaddy. Scammers specifically target GoDaddy domain names, why is that? Your answer, to me, sounds like GoDaddy is takeing a very weak/passive position towards scammers and hideing behind a grey area. I have heard reports from reliable people, of other registrars that do help to retrieve stolen domains and that GoDaddy has done it for some of there VIP customers. This is a classic case of "What would you Do?" "What is right?" Rather do the "right thing", It appears to me that GoDaddy chooses to use the legal grey areas and recent scammer activity as a way to promote TDNAM.
