"Freedom from unreasonable searches: The government may search and seize Americans' papers and effects without probable cause to assist terror investigation.

Right to a speedy and public trial: The government may jail Americans indefinitely without a trial."

Any candidate who does not endorse repealing the Patriot Act, is not a sound vote for the Presidency.

Great read, too many people blindly accept the patriot act without knowing what it really is... I wish the media would do a story similar to this piece...

The Patriot Act is unconstitutional, period. I am a strict constitutionalist, I would rather a tarantula lay eggs in my ear than change one of it's blessed constructs.

    Wow...

I applaud your respect for the constitution. Personally, call me an egoist, but the tarantula in the ear thing might be a bit much... haha...

It is good that more and more people are beginning to notice what is happening in USA. I am Canadian but I respect the principals in the Constitution and I believe it was one of things that made America great. It is funny how things change, 3 years ago when I was defending the U.S. Constitution in this forum, it was not a very popular concept and I was called "anti-American" but toady more and more people raising their voice in support of these principals. Fight for your Constitution and don't let the government take it away from you. :)

I really want to see someone from the other side come in and try to rationalize the vast differences here.

It's shocking how much of the Constitution is now "void where prohibited by law!"

No one should ever call you "anti-American" for suggesting we follow the Constitution. I'm glad more people are "raising their voice in support of these principals."

I'll play devils advocate, one times have change and while the constitution provides a great framework its not perfect either. We live in times that are changing fast and we need to change with them.

There is a process for legally changing the Constitution.

As gemini said, change the rules, don't ignore them. There is a reason the Constitution has a ratification process for new amendments that requires the amount of approval it does: so that it's REALLY hard to change the rules.

Yes I understand there is a process but the process is long and takes time while attacks can be planned, tried and executed usually in less then a year. For example the right in the patriot act to view medical records. Say has shown signs of being exposed to anthrax by the time you change/amend the constitution an attack involving anthrax can be already carried out. While access his medical records would show that they been exposed to anthrax or any other weapon type chemical.

Fear does have a very strong effect on people, doesn't it?

    I agree.
Do you know it is a reality that at least 89 American cities and towns have local governments which have passed resolutions saying the 'Patriot Act' is unconstitutional?

Fear has a strong effect on some, others it's just common sense.

When we ignore the rule of law, and descend into paranoia and fear, we're embarking on the road to trouble.

Freedom that we continue to be told is what the terrorists hate about us is much more important than a little possibly false safety.

If the terrorist hate us so much why give them what they want? According to our own administration, afterall they hate us for our 'freedom' doesn't make much sense taking our 'freedom' away to fight them now does it?

The problem is that people fear the wrong thing. While the chance of coming in contact with a terrorist action is minimal and insignificant for anyone, the dangers of dealing with a rouge government with no respect for individual rights is real and present. We have to deal with government and it's Representatives such as bureaucrats, custom officers, IRS agents, Police on constant basis in one form or another and it is a dangerous road when we as individual will have no rights against them.
