Patent need help

    I know a new concept/idea to make money online. But, I see that someone has implemented similar idea into business, in small scale.

    How can I know that this guy haven't filled a patent for this idea?

    Can I fill patent if this guy haven't filled patent?

    Is it ok/ethic if I fill a patent, and then launch the business in large scale?

    My concept idea is better than his idea, but it is similar.
