Part time business with FULL time job

    Hi,

    I'm a fresher from India completed my degree this year. Now, i have to join a software company. That company requires me to sign a contract for two years. Since, I'm a fresher, its important for me to get some industrial experience, so i want to join this company.

    Apart from that, i have my own online business which is generating good income for me. I don't want to leave my part time business as well.

    Now, the problem is that like most of IT companies, in the contract which i have to sign, they say that you can not work on full time or part time basis for any other company or a business.

    So, My question is what legal problems i could face if i continue to work on my business along with this full time job???

    My business and job both involve some software work but in different domains. I know i could get fired but what else they could do????

    I'm not real familiar with laws in India, but in my opinion you can continue to work on your side projects and work for the company. The main thing they are concerned about is taking their clients.

    What is your degree in? programming or design?

    Thanks for your reply.

    Since they are forcing me to sign a contract where one of the clause is forcing me to quit my business, i'm concerned on this matter.

    BTW, I have done Software engineering. Where are you from??

    As far as my experience is concerned. I do not honestly think you will be in a problem unless you are either working against your company or trying to promote your company's competitor's products online.
    The best example I can give you is google support team, I have a close friend of mine working with google in India. According to him they can do business online/host sites but they are not allowed to use or register for adsense or use any other google related promotional tools for their personal sites.

    i think if it's your own part time business there's no legal problem.. the problem comes with working for 2 employers where they compete against each other.

    You can only work for your "part time business" in spare time , i.e. not in company's work hours.

    If there is any business or product created by you during the working hours of your job ,legally the company will own the product and and all the profits generated from it , not you

    still not took the final decision....but i think i would go for job with doing business in part time...

    yeah. how would ever they unless you tell them. they said you can't do part time business with other companies not online bussiness. online business it not company.

    They said you can't work for any other company, no business or professional services part time or full time.....

    Btw, i'll do my part time even if i join them...

    Is your business an actual business? As in, a registered business or company in India? Or is it simply an activity that you undertake and earn money from?

    If it is not a registered business or company then you can absolutely continue on and call it a hobby that generates income. (This is similar to what engineers who also program mobile applications in their spare time often do.)

    the conditions imposed by your employer in the contract of employment sound reasonable, most day job is from 9 am to 5 pm, a second job or business not intruding into that time is i think non of your employer's business.

    Very old thread, six month passed. I'm doing only my business now & I can say you I TOOK THE RIGHT DECESION.
    I can concentrate more on my work now without any hurdle of job.
