Opt in email

I have done a search on this and no luck. I see opinions both ways, but my precise question is are they legal.

Lets say some of these companies I find that say they have been around since 1997, it has an actual phone number and address. It looks good to me.

I just do not want to do something wrong.

If they opt-in then it is legal.
If you just harvest email addresses via a program then it is illegal.
