I'm curious to see what everyone's thoughts are on this: Am I allowed to create a review on something without the owner's permission?? Here's a theoretical scenario: I want to publish a blog-post that is a non-sponsered (I didn't get paid to write it)review over the iPhone. I never asked Apple for permission to review it, and although I have honest, valid points made throughout the review, does Apple have the right to tell me to delete my review at anytime? I'm just interested to hear more from everyone on this, as a colleague and I were discussing this topic, and he believes that a review is fair game, regardless of the content within the review? Thanks
If it's an honest review, its your opinion, and doesn't contain lies or falsehoods or accuse them of dishonesty or illegality, then I don't see how they could make you to remove it....doesn't stop them trying though, or sending letters from lawyers, or threatening court action if they don't like what you say.
What a sad society we have created where people have to ask this question. I wish it was, but that's not a slam against you, LocalWriteUps. I wish it was outlandish for someone to not know what is and isn’t safe to say. Unfortunately, in this litigious/DMCA-slapping/IP-protecting day and age it’s completely understandable to not be clear on what's safe. With that said, I think you’re okay writing that review. Again though, that doesn’t mean you can’t get threatened with litigation or a DMCA notice.
Your question was: Am I allowed to create a review on something without the owner's permission?? My answer is yes.
