Opening an LLC in USA from india - legal problems

    Hi,

    I recently noticed 2 similar site:-
    valisinternational.com
    myuscompany.com
    (there are many other similar site).

    They claim to open an us llc from anywhere in the world by just giving their fee. They claim to provide EIN, Apostille, Certified Copy of Certificate of Inc/Formation.

    My questions:-
    1. Is it really legal??
    2. Is those website scam??
    3. Anybody used it before??
    4. Where should I submit the tax. I guess my individual income tax should go to Income tax dept. of India. Whereas my company wise tax goes to Delaware state of USA. Am I correct.
    5. Using Apostille can I open a bank account in India for the US LLC.

    Interesting questions. I've actually been thinking about the reverse: creating a company based in India even though I reside in the U.S.

    I think a lot of companies in the U.S. are created by lawyers on behalf of their clients (the owners); the lawyers basically do all the work and the owners just pay them and sign the documents (and run the operation, of course). I don't remember any requirements that state that a U.S. company needs to have U.S. residents as owners, but I never really checked since I live in the U.S.

    I had a California corporation, and my taxes went to both California and the IRS. I don't know what those websites said about where your company would officially reside, but generally speaking, the taxes would go to both the state as well as federal government. Different states have different tax rates and tax laws, and there's even a third level of taxes: paying taxes to whatever city your company resides in. Also, if your company does business in states other than the one it was formed in, you may have to pay those states some sales taxes.

    I should warn you that the tax returns for a corporation are very long and complex; I spent around $500/year for someone to file those for me. LLC tax returns might be a lot simpler, but I never had to deal with them. There are also seller permits, etc. that you may have to purchase, depending on your business.

    Would it be better to open one in England, as the taxes and returns will be easier?
