In the US (and several other countries) this has been deemed copyright infringement depending on the implementation. One is essentially trying to make money by wrapping ads around another person's site. Bad form at any rate.
i agree and that was my thinking; but i have seen lots of professional looking site doing similar things..
Some very big sites have done this in the past (or still are) such as About.com and AskJeeves. When questioned why About.com does this the CEO said AskJeeves does it and they haven't been sued so we did it. The reason it still happens is that few cases have actually been decided in court. Most have been negotiated outside of the court. Of those that have been decided by a judge, the rulings are seemingly inconsistent (in the US). Whether they are actually inconsistent would be for a lawyer to determine. Wrapping the frame in ads is more likely to be seen as infringement as the point would be for monetary gain.
