Today I noticed that an affiliate for one of my Clickbank products is running an ad on Yahoo Sponsored Search which is basically claming to be me... "xyz.com Official Site Official Site - Special Offer - 90 Day Guarantee. xyz.com" Now, this is obviously not the official site... it's an affiliate sending traffic to the affiliate page of my site (which is slightly different than the main page). Also, I don't offer a 90-day guarantee on this product. I'm surprised that Yahoo Search would allow the words, "Official Site" without verifying it via a whois search. I value my affiliates and want them to be successful. On the other hand, I can't have them claiming to be me and possibly making claims that I would never make. What do you all think... is this a potential legal problem for me, or is it just a clever affiliate thinking outside of the box?
It happens reasonably often with clickbank-I've clicked on so-called "official" site ads only to be led to a page with affiliate=xxx in it. Now unless this guy is making hazardous or outright fake claims about the products value/efficiency etc. You may not have a problem on your hands. Also-isn't it mentioned in your sales page that there's a 60-day money back guarantee?. This guy should know better than to advertise for a 90 day one.

Check the page, if he's not making bizarre claims - thank him for his traffic. When I see this I chuckle at how smart/aggressive aff's can be - as long as there is nothing that may get you in trouble there, I would be thankful for having someone on board with PPC. The landing page is an extension of your product/campaign so technically it is still part of the official site/brand (sneaky).
I'm surprised that you think Yahoo is going to do your legal work for you. That's your responsibility, not theirs. And how would Yahoo know if you and the affiliate in question didn't have an agreement in place for the affiliate to act as the official site? Send Yahoo a complaint. That's the best thing to do. Besides warning if not dropping the affiliate in question.
I agree... If he is not causing you complaints I would leave him be. The 90 day vs 60 could be a simple mistake. If he is making you money you would not get otherwise get, that should cover any 60 to 90 returns you may get stuck with I would guess.....
