    I search on google for "free ringtone" and find this site www.ringtonesgalore.co.uk #1 possition. See there some ads by google and i am verry courios, how much he can earn and its not against of tos to have ringtones in same page with google ads ? are not that copyrighed material ?

    I do think that that part of the AdSense Terms and Conditions could be phrased a bit better. Google doesn't want to be a party to copyright infringement is the best way to think about it. It seems to me that these guys haven't licensed the material, so I would argue that they're violating the terms because of that. But Google doesn't actively review every site that shows ads, so often it takes a complaint from someone to get them to investigate.

    Well, it will depend on the agreement they have with the publishers of the ringtones. Perhaps they have licensed them, and in that case Google shouldn't have a problem with it.

    I agree, it's hard to know exactly. At a glance, though, I'd say that they don't have licenses. I don't see any messages to that effect. But I could be wrong, I haven't explored the site in detail...

    As always, if there's something you want to do that you think may violate the TOS, always best to email Google and ask first.

    what type of ringtone are they, if they are .midi format tones (like polyphonic ones) then they are freely available anyway.

    "Freely available" doesn't mean anything. Whether they're MIDI or not, they still infringe on the rights of the music publishers. That's the problem.

    That really applies to anything you put on your website, not just MIDI files. Especially in light of things like the DMCA.
