Ok, I have an issue...

    I have a company called NAME Public Relations and someone else has a company called NAME communications.

    The "NAME" is the same as mine except for the last part, we both do PR, but we both do diffrent types of PR.

    Is there any legal issues???

    The answer is really dependant on the name first and foremost.

    What it is, who used it first maybe and so on.

    I.e green ... is hardly gonna be an issue like pauls or similar, however, tardis or whatever it may be if in same city or area could be.

    Well, whoever penned the name first has probably got an issue here i would imagine.

    However, does there need to be an issue?

    Are you in the same town?

    First with the name could possibly complain to the relevant departments i suppose, however, hard to win anything.

    Either of the 2 concerned regd the trade mark? If not well why worry, just try and regd trade mark before you complain if thats what you want to do.

    Personally i would not bother.

    I am in CA and he is in NY.

    I have applied for LLC status and will apply for the trademark soon.

    So why would there be an issue? Hard to get much further apart.

    Whoever regs the mark first will more than likely be the national winner if there is an issue.

    Since the names are not the same I don't know that you need to do either unless you are going national. Maybe not even then since they are not the same.

    For pure protection the 3 year trademark process is alway better. Have you even searched to make sure some third part hasn't already registered it in that class?
