OffShore Warez Hosting [Linking too!] Netherlands Datacenter [Unmetered]

    Well about the linking thing, I am not absolutely certain about that. There have been some trials like the Everlasting trial, and it ended up negatively for the hosts.

    I do know many hosts that allow it, and they are reputable companies, it is not their fault. Ecatel and Leaseweb both have very large customer amounts and can be regarded as pretty trustworthy, but still they base themselves alot upon controversial protection.

    However, as Wimpie pointed out, warez hosting at usenet is completely legal in the Netherlands, some of the biggest providers host it.
    The linking of files is not very certain in the Netherlands, but for smaller sites will not deliver much of a problem. However, looking at many lawsuits wich are still running, we could see a turnaround in this soon. It could still be in favour of the hosting companies. But it could also be the other way.

    In the Netherlands these lawsuits can take months up to years, there are and there have been also several cases against the google group. Google as you know, also uses a system that links to warez. Since they do not consistantly censor this out, they are in the same constant violations as the torrent sites, a court will not see much difference.

    Recently we saw the site www.torrentspy.com getting attacked by the brein group. It was hosted at the Leaseweb location. It linked directly to torrent files. It got taken down. However, using a method that didnt link directly to the torrents, but only linked to the pages wich actually had the links to the torrents on them, they used a system similar of google linking. So they started up again with that new system. They went up again a few days later, at the Trueserver network, in the Netherlands as well. They ran for a couple of months more and have now finally gone out of service because of the constant problems with the law.
    This however does not mean they are now all in jail.

    If you have large user networks like that, and get alof of attention, you will get the groups coming to claim money from you. This is not the government, the government does not involve in these copyright things. This is different if we would be talking about something like creditcard fraud. Copyright infriction is something else. These are private groups who start lawsuits against anyone they believe is not listening to their rules and who is not accepting their ownership of content.
    While it is not actually listed in the law, they have the ability to refer to older cases, and they base it upon trying to show as much evidence as possible that you are actually making money and they are losing from it.
    These are private groups with common interest that use groups like BREIN to maintain their rights on the internet. They do not base their case upon the method of linking, they base their case upon the fact that you make money from things they lose from. How you do it is not important for them.

    I think I will give it a try anyway, and I hope I will not be forced to move to malaysian hosting companies after a bad experience in Netherlands. But thanks to your help, now I couldn't say that I didn't know the risk if I have some problems. ;) I just regret that russian hosting companies with pages in english are hard to find. I think it would be the perfect compromise for me beetween distance and warez-friendly laws (or just lack of laws). I will continue my investigations but I've added this thread to my bookmarks so I will get back here if I find no better solution.

    By the way, I would like to thank you all for your good work. The DigitalPoint community is precious for users like me, avoiding us to do mistakes or fall in some traps.

    Darksanity has 7 negative iTraders in past 6 months. Number of positive in the same time: 0. And many peoples saying that Darksanity is a scammer. I don't know the truth, but many peoples seem to have the same opinion (most of them are victims/ex-client). Beware!
