It is not legal, of course you as the owner will be at risk. Whether or not you will be prosecuted depends on the offshore country you are in. But it is illegal and I strongly don't recommend it.
It is not just the risk, it is not ethical and it is not legal. There are a lot of other ways to earn an honest living.

Anyway, isohunt.com and wtalk (I think) are located in countries where prosecution is rare/not happening so I recommend moving your servers to like Sweden or something. Anonymity is good. Look up where to host warez sites on google, might help. Good luck.

There is no risk in anything if you do host with a good host. As for example, the everythinghost guy in Dp who's really lenient on this as his server is located somewhere where he can be lenient Cheers.

check for servers located in holland, because of their laws, many of their hosting providers allow copyrighted files to be stored on their server
I would just like to bring up a few things. Warez linking no matter what country you are in is always risky. Copyright material distribution weather its linking or storing; the 2 are affiliated greatly with each other. You can still go to court and hope that the judge favors your side but i'm sure that since the government is cracking down that he wont and you will be sued with copyright violation material and you will serve time in prison and / or possibly be charged A LOT of money from the person of the software or w/e you are illegal linking the download to. The reason people choose offshore hosts is simply because the government is not stabilized to punish or enforce proper AP laws or any law passed by their law makers. (Ex: Malaysia) I don't know about you but some of the other foreign countries have HORRIBLE courts (EX: turkey ) they'll treat you like a REAL prisoner if you are found guilty. Those are just a few things to think about when choosing your host. However there are thousands if not millions waerz site out there. The number is dramatically increasing and the intent to stop and crack down is also becoming larger. Now, if your just a small tiny warez site they wont pick on you. They're cracking down on larger sites with 100's of thousands of members involved

US gov can NOT take you to court or order a site shut down in a number or regions/areas int he world. It's up to you to find those countries
Not to turn this into a debate, but record companies are hardly the most moral of businesses, I don't care how much money they throw at politicians to get them to enforce ridiculous laws. When they're not bribing politicians or radio stations, they're installing trojan rootkits into CDs and hacking filesharing sites with denial of service attacks. Just because filesharing is illegal in your country, doesn't make it illegal around the world so get off your high horse. Back to topic. If the owner of one of these sites has it hosted in offshore - but still resides in a country where it's illegal, what happens?
Companies spend money developing software, promoting singers, doing R & D in medicine etc. It is their rights to enjoy the fruits of their labors. They are granted copy rights according to The Vienna Convention. It is illegal around the world or nearly around the world especially if the country wants to join the WTO. There is no high horse or low horse, nor do I care about the money politicians got. It is the basic rights of a company to protect its intellectual assets. If no such rights existed or such rights are so easily infringed. Who would wonder to do research, to develop new software, to groom singers? Everyone will just be preparing a warez server for the latest release if there will be any....
R&D in Medicine? What the fuck. The bloke wants to host some torrents or some shit, not create a fake viagra sweat shop. Even if it's nearly illegal around the world, noone really gives a shit... case in point: China (that's 1 in 5 people around the world, at least). I'm not saying that record companies shouldn't extort the fucking heavens out of the poor saps who sign their contracts, and I'm definitely not saying that it's immoral for them to heavily overcharge for music, monopolise the markets and take a disproportionate cut, no. I'm saying that they aren't the most moral of businesses in that they've broken a hell of a lot more laws than the kids who they're suing for downloading a song, but they can bribe their way out of things and have expensive lawyers in shiny offices and bespoke suits. Moral of this story: check yourself before you wreck yourself.
I have checked myself carefully. But would appreciate you hold back on those four letter words in a public forum. Even China is giving a fight against piracy as stipulated in the WTO. Whether they are moral or not is not for us to judge, but whether the copyrights are legally theirs and are infringed is something uncalled for and illegal.
When was the last time you went to China friend? I can assure you, the government does not take copyright seriously, no matter what the tell the Western governments. I'll say this, it's hard to find an author you like in China because there's so many published pirated books.
If someone robs a bank and succeeded, does not mean you need to rob a bank right? So what if China is still a piracy heaven? It will be a matter of time for them to enforce piracy as they too wanted to protect their own intellectual rights. Sorry have not been to China for about a year, and not very interested in going to China.
