Notional Principal Contracts

    Hi,

    Does anyone know if I have to put a check mark to this check box on an affiliate agreement W8 form certifying that I am not earning income living or doing business in the United States?

    Here's the line:

    I have provided or will provide a statement that identifies those notional principal contracts from which the income is not effectively connected with the conduct of a trade or business in the United States. I agree to update this statement as required.

    Do I have to put a check mark above?

    Well, yes. Because they need to show to the IRS that they don't need to pay or withhold taxes for you. So as long as you don't do business as mentioned in the form, go ahead and click it.

    If you are, you need to send in the proper documentation so that taxes and reporting can be made and done properly.

    How can I prove that I am not doing business in the United States?

    I don't know how can I prove it?

    What kind of documentation is needed to prove it?
