    Did it ever occur to anyone that all he had to do legally is just add a notice to his index page saying Proxify is a registered trademark of Upside Out Inc and his site is in no way affiliated with Upside Out?

    Its speculation purely at this point. I think the reason behind people using those disclaimers should be looked into by everyone.

    It's a simple reason, and it's the same reason people put "Terms of Service" on their sites. Neither has legal credibility, but people put them there to ward off other people who might try to sue them. They think if they put something like that on the site it will deter people from taking legal action.

    But I guess the main reason people do it is that everyone else does it :p
