Can a web site that is non-commercial, advertise for third party, without out receiving any payment for this advertisement.

And base this advertisement on (PSA):
    • Stimulate inquires for information
    • Improve public attitude

Or this ACTION would case web site to be considered commercial?

Note: advertised third party would be an online poker school (registration there is free).

Advertising for an online poker school certainly sounds commercial and in most cases would be, but there are exceptions. The obvious question is why would you desire to promote an online poker school if you are not benefiting in some way. Advertising for a poker site is hardly a public service, as you try to spin it.

Why is your self-designation of "non commercial" important? Usually, that is something that only comes up in litigation as a justification for using someone else's materials.

If my website is considered commercial, than there is piratically no picture or even quote I can use for NEWS or any other section... If it's considered non-commercial than I can use some of CC (creative commons) works at-least...

btw, really thanks for the response :) , didn't except I will get any response, since I m kind a new in this forum..

It's mostly not considered a commercial ad since you're not receiving anything for it, but the registration is not free, so I'd say that it is commercial in that case.
