For 5 1/2 years Uzi Nissan has been dragged in and out of court spending legal fees in the 7 digits to keep his domain name Nissan.com Nissan Motors relentlessly goes after their claim of Trademark infringement, but so far the judges have been ruling for Uzi. Uzi Nissan has a computer company called Nissan Computers and even though http://www.nissan.com is no longer used to sell his products (a judge ordered him not to), it started out that way. What do you guys think? Does Nissan Motors have a right of ownership or should Uzi Nissan keep it since he registered it first and in good faith? More info on http://www.digest.com
I think if it was good faith and they aren't trying to capitalize on the car manufaturers name, they should be able to keep the name. I never understand why a company can try to claim a domain just because they are bigger. I imagine Uzi turned down a lot of dough for that name. True, the average person wouldn't fork over 7 figures to lawyers over a domain name and they know it.
Any progress on this issue?? Sort of hoping to see the guy be able to use his computer shop on there again.
It's his name and it's his domain. I think the judge should order Nissan to pay all of his legal fees. I think it's completely asine Nissan Cars should even be allowed to take him to court. This makes me angry. Even if Nissan made a car I could fit in I would still never buy it.
hehe..in my native language nissan sounds like "nisan"- which means tombstone. Ironic isn't it? Anyway, that guy should keep it. If Nissan Motor wants it, they should pay the guy for the domain name + his legal fees. He's not a squatter.
Typical corporate greed. They have no right what so ever to have the name. But they can sue joe blow into subbmission. I'd never buy a nissan product anyway, so screw them.
It sounds like there's a consumer action issue that could be attempted, to help remind the car maker that their actions could be influencing consumer decisions, as a direct result of their behaviour on this issue. And progress is...? Still fighting?
I, Brian, I saw that Mike didn't hit enter on his last entry using my laptop and I didn't read it to see if he finished his thoughts. LOL sorry, my bad. My will have to answer you tomorrow.
I wonder how much money Nissan Motors was offering him, if any. If it was somewhere in the millions I would take the money, and use it to start another 10 computer shops
Yes, no end in sight. The judges keep actually siding with Uzi, but Nissan Motors keeps finding more and more legal loopholes to go after him.
I think the guy should keep the domain, and I think that having ads for cars or whatever should be OK. If he were selling nissan cars through a dealership and getting a commission I think there might be a conflict, but having things like adsense up, etc. is a logical step for him to take. It's his last name. He didn't try to blackmale them. He didn't even start out the site with cars in mind. My dad started a company under our last name. It became public and has now been sold privately 4 times. They still make products bearing our name. Should the current owners of the company be able to take away my family domain? Or prevent me from doing anything in that industry? I don't think so. It's my name and I'll do what I want with it. If anything they should be proud to be associated with me.
I've been watching this case for 5 years now. What also surprises me is that the media won't touch it. It's something that Nissan would NOT look good with having on their record. Seems as if they are afraid of Nissan Motors.
This sounds like something that everyone just needs to spread online. I'd never heard about it before. Could you imagine what would happen if everyone started putting this in their blog, adding a page to their sites, or emailing people about it. Online media would pick it up. Then regular media would have to cover it. It looks like to me if Nissan started getting a lot of email and hammered everywhere online they'd change their policy. Companies hate to look like a big bully.
You just watch the news now, some dude from the AP reads digitalpoint and will start checking into this. I do remember about 4 years ago reading about this nissan thing before.
